This website is owned and operated by the Stow Cottages at Chautauqua LLC, 5173 Stow Ferry Road, Stow, NY 14785. These Terms set forth the terms and conditions under which you may use our website and services offered by us. This website offers visitors vacation rental properties, available to be booked by guests/visitors. By accessing or using the website of our service, you agree that you have rear, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 18 years of age and possess the legal authority, right, and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

The prices we charge for our rentals are listed on the website. We reserve the right to change our prices for rentals displayed at any time, and to correct pricing errors that may inadvertently occur. Additional pricing details is available on the checkout/payment page.

You agreement to indemnify and hold Stow Cottages at Chautauqua LLC harmless from any demands, loss, liability, claims, or expenses (including attorney's fees), made against them by any third party due to, or arising out of, or in connection with the use of this website or any of the services and rental offered on this website.

Accidents: Stow Cottages at Chautauqua LLC' property at 5173 Stow Ferry Road, Stow, NY 14785 is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. Stow Cottages at Chautauqua LLC is not responsible for the loss of personal belongings or valuables of the guest. By accepting/creating any reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

Water dangers: Guests acknowledge that the Stow Cottages at Chautauqua are situated directly on a lake. This large body of water has many inherent dangers associated with it. Guests acknowledge that management and the property owner, Stow Cottages at Chautauqua LLC, are not responsible for any accidents or injuries arising from use of the lake. Guests assume all responsibility to ensure each renter and their guests are safe including the use or non-use of life saving equipment such as life jackets. This clause is in force for both owner-supplied watercraft and/or guest supplied watercraft or no watercraft.

Boat waiver: Guests acknowledge that any boating equipment on-site is used as-is and that management and the owner, Stow Cottages at Chautauqua, LLC, are not responsible for any accidents or injuries arising from use of equipment. Guests assume full responsibility for use of all watercraft. Stow Cottages at Chautauqua, LLC assume no responsibility for injury or death as a result of use. Guests acknowledge that they have a duty to inspect all watercraft prior to use to assure that it is in a safe and proper condition for use. Guests acknowledge that the property owners are not present on the property and that Guests are in a better position to inspect any watercraft prior to use, than owners are. Children will be supervised at all times while in any watercraft. Guests agree to wear life preservers at all times when in any watercraft. Guests agree not to operate any watercraft after consuming drugs or alcohol.

Falsified Reservations: We do not rent to parties under 25 years of age unless accompanied by an adult guardian or parent. No proms, spring break parties, or large gatherings are allowed, chaperoned or otherwise, no exceptions. Any other person in the property is the sole responsibility of Guest. Subletting or subleasing the property is absolutely prohibited. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

NO LIABILITY/INDEMNIFICATION/HOLD HARMLESS: The owners of the property, Stow Cottages at Chautauqua, LLC do not assume liability for the loss, theft, damage or injury (or death) to persons/guests or their personal property. Guests agree to indemnify and hold the property owner, Stow Cottaget at Chautauqua LLC, harmless for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guests’ use and occupancy of the rental property, including but not limited to claims for personal injury or property damage/loss.

To the maximum extent permitted by applicable law, Stow Cottages at Chautauqua, LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, or any nature whatsoever, resulting from your access to or use of our service or property; and (iii) any unauthorized access to or use of our secure servers and/or any personal information stored therein.

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. Your continued usage of the website or our service/property after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service/property.

These Terms, the rights and remedies hereunder, and any and all claims and disputes related hereto and/of to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of New York State, without respect to its conflict of laws principles Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in New York State. The application of the United Nationals Convention of Contracts for the International Sale of Goods if hereby expressly excluded.
